Gratuity Payment & Rakesh


One fine morning Rk (one of our Employees) asked me ” Sir, what is gratuity & am I eligible for the same “। I knew his intention ad asked some time to give complete and factual answer & he agreed। I recalled my books in Labour laws and summarized him in this way & I am sure the summerization will clear the basic doubts & ambiguity about gratuity।

Gratuity is a retiral benefit only which is applicable to all those establishments which are registered under the factories Act & the shops & establishment Act।But this is optional for certain establishments.

  • Employees can claim the gratuity payment or the Employer can give the gratuity to the Employees only if the employee has completed at least complete 5 years of continuous service.
  • Gratuity is calculated on the last month’s basic+DA and the gratuity calculation is as under
    Gratuity Payment = Last Salary drawn * Number of years completed * 15/26
  • Last drawn Salary = Basic+DA
  • Number of Years completed = ignore below 6 months & count a full year if more that 6 months
  • 15/26 = 15 days salary per 26 working days
  • Maximum gratuity payable to any employee is 3,50,000
    But folks please take a note that any break during the service will not fetch you gratuity. Transfers are allowed under the same employer nut not the rejoining cases.

    With this i have roughly covered all possible general information about gratuity for a Lehman & hope things are pretty clear.

Mujhe yaad hai bahat din pehle main aur pramod sir office ke bahar baith ke jab baein kar rahe the tab mujhe unhone kaha ke money plant lagane se paisa badhte hain aur main use sach man bhi lia। Phir mujhe ameer ban ne se kaun rok ta to maine turant hi apni nazar daudai aur aas pados main lsge hue sare paidho me se money plant dhundne laga। Peeche se Pramod sir ne phir kaha yaar aise nahiin hota money plant churana padta hai to ek minit ko main ruk gaya par kisko dhanwan ban na manzoor nahiin aur waise bhi ek paidha hi to gayab karna tha to maine aao dekha na taao apne building pe hi lage hue paudho pe hi haath saaf ki। Dosre hi din ek badiya si container lia gaya aur mere desk pe sajaya gaya… par mujhe aaj bhi shak hai ke mere bank balance pe kuch khas farak pada hai ya nahin( par paudha ab bhi tandroost hai)।

Reforms in the Educational industry & the other side to monetize the Market..

In a landmark decision in the educational industry the union minister for Human resource Development has given a nod to all the international universities to open campuses in India and hence opened up the gate for all the biggies in the educational institutes across the world to peep into the huge market in India. To call it a land mark decision I would not agree to what the minister has done is right. Because the Indian education industry is a much big market wherein the foreign players will definitely look at. But there is a question” is the foreign degree provided by the foreign university will keep the same value, if the same is obtained in India”. I personally would not agree to the fact. i remember my batch mates in MBA were looking for a degree from the Massachusetts or Harvard or Oxford but it was quite a tough task to get that. But people were doing that and there was a feeling of achievement and accomplishment after doing that degree. But once the decision is rolled out then my friends who have done a degree from an European or Australian university would definitely be little frustrated. But yes the degree from the top most colleges like the Harvard/Oxford will have their own repute & people in all age would strive to get that world-class education whether their campus is in India or anywhere else.

My question again; will any institute of that kind will be coming to India ? is there any criteria set for the universities to come into India or any other University in Libya or Ghana which my ancestors had no idea can come to teach us ? I am sure that the minister has no answer to that the except ” the cabinet committee is reviewing the final memorandum before it is explored.” Being under the WTO we cannot deny any university to open campus & run courses and hence can loose control of the private and anonymous universities to play with the future of our students. I would request the minister to get strict standards set so that good universities/Institutes can come to India to deliver world-class education. Secondly can we again strengthen our own educational system or existing Good universities at every state level to compete with the foreign players. If no then this step by the government is like a lethal weapon against our own education system. When we are diminishing the number of Deemed universities to keep private players out of the scene then how can you leave the platform all set for the foreign players to explore. If the Indian Economy is growing by 10-12% every FY then why cant we spend 4-6% of our GDP in strengthening our Education system which a developing country like ours must afford to fill up the requirement of skilled manpower which we foresee 10 years down the line ? Look at China who is investing nearly 6% of its GDP in education system for the last 8-10 years and as a result of which the foreign students’ number has substantially increased in number because of the uprising standard of education. Now its time to strengthen our existing education system, empower the IIT’s,IIM’s & other that level institutes, Open up new institutes of that repute and finally setting standards for all the foreign player in the industry to secure the future tutors else people will come, collect huge amounts in the name of any other university in Europe or somewhere else leaving us nowhere.

there are many a things in life that don't need any explanation and you too dot feel the way to ask the same reasons as well and i am sure you will agree to my words here. things like why people care for you so much and why you become so loyal to people and at times with few material things...these days i am too experiencing the same and i really fall in a decision where to go with the questions. Even people too in reply want the same from you as well and after all my introspection and many analysis what I find is an answer to this questions.My answer to all this unquestioned things the answer is "human is a social animal unlike other living things." to personalize this post " i am missing my things,my people and my days...

HAPPY HOLI

There are many occasions when it was a unwanted display of entertainment and today we all friends displayed the same. And the occasion was Holi. Usually i don't play Holi but today we played and the same was triggered by one of our friends who hap preplanned it. He woke up early and got some colours from the market and it was early morning 8.30 when we all were enjoying the off day.He suddenly entered the room and first asked us to come out of the room then one by one we were colored. Sooner we were out of any dilemma we were charged up and anticipated the same way.Thereafter we went out in search of other friends in the area and got 3 friends and colored them. One of us had a dirty sticky color which was used on faces and you wont believe the faces were so black that we could not recognise ourselves in the mirror.But after all it was a healthy enjoyment.with the colored faces we were all one and i think that was the message we passed to others that after all dissimilarities we all are humans first then anything else...anyway we enjoyed it thoroughly and hope you had your part....
